Since 1 July 2026, NSW food businesses producing around 3,960 litres or more of general waste a week must separate food organics under the FOGO Recycling Act. The threshold drops to around 1,980 litres in July 2028 and around 720 litres in July 2030, which will pull in most cafes and restaurants. The tiers are measured by residual general waste capacity, not seating count.
